Dr Panduleni Itula’s case against the health minister in which he is challenging the legality of the Medical and Dental Council of Namibia has been postponed to the 3 December 2020
The case is finally postponed for the hearing and determination of the outstanding issue of costs, due to the applicant’s counsel’s inability to appear today due to medical reasons.
The court has ordered that no further postponement will be granted in this regard and the issue of costs will be determined with- or without the participation of applicant’s counsel on the date set in this Court Order.
The determination of this week’s wasted costs is to stand over.
Itula has told the court via an urgent application that the health minister composed the council using an act that had not been gazetted and thus not become law yet.
He has also said that the minister only picked dentists that belonged to the Namibian Dental Association only which he said discriminated those that did not affiliate with it.
As such, Itula has said that this is a violation of the Namibian constitution on the basis that the process was not fair, and gives those that belong to the association the advantage to advance their career.
