Despite legal requirements under the current Minerals Act, only one mineral agreement has been established to date — between Namdeb and the Namibian government.

According to Erasmus Shivolo, the Mines and Energy deputy executive director, Section 49 of the Minerals Act allows for a mineral agreement to be formed between the minister and a mining licence holder. These agreements typically include provisions such as identifying the ultimate beneficial owners of the licences and ensuring budget security.

However, Shivolo noted that, while the law mandates numerous disclosures and other requirements, this particular section of the Act has been largely underutilised.

“The only mineral agreement that exists is the one between the government and Namdeb,” Shivolo stated.
